Terms of Service
These Terms of Service ("Terms") govern the relationship between Nexa Démolition inc. and any client who requests, accepts or receives our services. They apply to any quote issued on or after the date above, unless otherwise stipulated in writing in a specific contract.

2. Services offered
Our services cover: residential, commercial and mechanical demolition, asbestos abatement, mold remediation, and general interior stripping. Every job is carried out in accordance with CNESST standards, the Québec Construction Code and the regulations of the relevant borough.
3. Quote and acceptance
- The quote is issued after a site visit by our estimator, generally within 24 to 48 hours.
- It is valid for 30 days from the date of issue.
- It becomes contractual as soon as it is signed by the client and countersigned by Nexa.
- Any change to the scope of work is the subject of an amendment signed before execution.
4. Price and payment
- Prices are in Canadian dollars, excluding sales taxes (GST and QST).
- A deposit of 30% is required at signing to reserve the project start date.
- An intermediate payment of 40% is due at the start of on-site execution.
- The remaining balance of 30% is payable upon clean handover of the project site, on presentation of the final invoice.
- Payment by Interac transfer, cheque or bank transfer. Late payments bear interest at the legal rate in force in Québec plus 2%.
5. Permits and authorizations
Obtaining municipal demolition permits is the client's responsibility. Nexa prepares, free of charge, the required technical documents (demolition plans, method, risk analysis) and can take care of the process under written mandate. Permit fees, preliminary expertise fees (asbestos, structural) and utility disconnection fees (water, gas, electricity) are not included, unless expressly stated in the quote.
6. Execution of work
- Nexa assigns a dedicated site supervisor, the client's single point of contact throughout execution.
- Daily photo reporting is sent to the client, with a log of milestones reached.
- Work hours comply with municipal noise regulations; work outside standard hours requires prior authorization.
- Removed materials are sorted at source and directed through approved facilities (Recyc-Québec), with manifests kept on file.
- The site is handed back cleaned, with a compliance file (asbestos certificates, CNESST reports where applicable, before/after photos).
7. Timelines
The timelines indicated in the quote are given in good faith. They may be adjusted in the event of force majeure (severe weather, strike, municipal permit delay, discovery of undeclared hazardous materials). Nexa informs the client without delay of any extension and agrees a new schedule in writing.
8. Liability
- Nexa is covered by a civil liability insurance of $5 million.
- Nexa is liable for direct damages caused by its fault or that of its subcontractors, within the limits provided by its insurance.
- Nexa cannot be held liable for indirect damages (loss of revenue, prolonged loss of enjoyment, delay of a related project) except in the event of gross fault.
- The client warrants the accuracy of the information provided (access, plans, declared presence or absence of asbestos, state of utilities). Any misrepresentation releases Nexa from liability for the resulting consequences.
9. Site safety
The project site is barricaded and access is reserved for authorized persons. The client agrees not to enter it without express authorization from the site supervisor, and to comply with safety instructions (minimum PPE, perimeter). Nexa reserves the right to stop work without additional cost to the client in the event of a serious safety risk.
10. Subcontracting
Nexa may call on qualified subcontractors for specialized scopes (laboratory analyses, hazardous material transport, crushing). Nexa remains responsible for coordination and quality of work towards the client.
11. Warranty
Our work is warranted against any execution defect for 1 year from the date of handover. The contractor's ten-year civil liability applies in accordance with the Civil Code of Québec for the relevant works.
12. Termination
The contract may be terminated by the client before work starts subject to payment of the costs incurred (studies, mobilization, permits). Any termination during execution gives rise to invoicing of the work performed and demobilization costs.
13. Personal information protection
Processing of client data is governed by our Privacy Policy, which complies with Québec's Law 25.
14. Governing law and jurisdiction
These Terms are governed by the law of the province of Québec and, as applicable, the laws of Canada. In the event of a dispute, the parties undertake to seek an amicable solution before referring the matter to the competent courts of the judicial district of Montréal.
15. Changes
Nexa reserves the right to amend these Terms at any time. The version applicable to a contract is the one in force at the date of signature of the quote. The date shown at the top of the page corresponds to the latest published revision.
